By accessing and using Pool Nebula ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of our pool service management platform, including all features, applications, content, downloads, and other services we provide.

Pool Nebula is a customer relationship management (CRM) and service management platform designed specifically for pool service businesses. Our service includes:

• Client management and contact information storage
• Service scheduling and route optimization
• Work order management and tracking
• Chemical reading and maintenance records
• Billing and invoicing capabilities
• Customer communication tools
• Reporting and analytics features

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your registration information
• Maintain the security of your password and account
• Accept all risks of unauthorized access to your account
• Notify us immediately of any unauthorized use of your account

You agree not to use the Service to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, or inappropriate
• Impersonate any person or entity or falsely state your affiliation with any person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service for any commercial purpose without our express written consent

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of all data you upload to the Service. By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service to you.

We strive to maintain high availability of our Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Emergency maintenance
• Third-party service interruptions
• Force majeure events

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POOL NEBULA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us during the twelve (12) months prior to the event giving rise to the liability.

Certain features of the Service require a paid subscription. By subscribing, you agree to pay all applicable fees. Subscription fees are billed in advance and are non-refundable except as required by law.

We reserve the right to change our pricing with thirty (30) days notice to active subscribers.

You may terminate your account at any time. We may terminate or suspend your account immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately, and we may delete your account and data after a reasonable retention period.

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
